At this time, the NES does not contain a nationally consistent long service leave standard. The aim of the Australian government is to formulate such a standard in consultation with the State and Territory governments that currently have vastly different entitlements in place. Generally, employees continue to derive long service leave from pre-modernised awards and State or Territory legislation however, should an enterprise agreement contain provisions that exclude long service leave, specific advice should be sought from one ARTIO or one of the Branches listed on page 2 of this Handbook. Depending on the relevant State or Territory law an employee may be entitled to long service leave after 7 to 15 years continuous service and may be paid out on termination depending on the circumstances and the relevant legislation.
